Environmental Regulatory Applicability Review

The Environmental Regulatory Applicability Review (ERAR) is comprised of a one day facility walk-through during which, IES will make observations about which rules are applicable to your facility and make recommendations on how to comply with the appropriate rules. A brief report will document all observations and recommendations.
Topics Covered Include:

The following environmental areas will be reviewed:
1. Air Quality (Permits, Ozone Depleting Substances, etc)
2. Wastewater & Sewer; Stormwater Permits
3. Hazardous Material Training (DOT)
4. Hazardous Waste Management (RCRA)
5. Hazardous Waste Operations (HazWOPER), Emergency Action Plan and Hazard Communication
6. Emergency Planning and Community Right to Know (EPCRA)
7. Spill Control and Countermeasures Plans (SPCC)
8. Risk Management Plans/Process Safety Plans
9. Toxic Substances Control Act (TSCA)
10. Others – as applicable to your facility and industry
Benefits: Many companies are unaware of the environmental regulations applicable to their facility. Some of these regulations – do not have a high risk of fines and enforcement (i.e., NC Community Right-to-Know Laws), where as others do (NC Air Permitting, NC Hazardous Waste rules, others). By having IES conduct an ERAR assessment, your facility will possess a thorough understanding of environmental rules – applicable to your facility.
Services not Included: It should be noted, that the above service does not include conducting an Environmental Site Assessment (ESA), typically completed for an organization prior to property transfers. Sometimes referred to as a Phase I Audit or Due Diligence Audits, ESAs are mostly concerned with contamination of soil, groundwater (such as Underground storage Tanks), buildings, etc.
An historical search of property characteristics, as well as surrounding property environmental issues, is usually completed for a Phase I Audit. ESAs are not typically legally mandated for operating facilities – and therefore are not routinely conducted for ISO 14001 legal compliance audits.
